Terms and Conditions
This Rental Agreement (“Agreement”) is entered into by and between the individual identified as the Renter and Iron Horse Rental Co., LLC, a North Dakota limited liability company with its principal office at 300 Pacific Ave., Medora, ND 58645.
1. Purpose of Agreement
Iron Horse Rental Co., LLC operates an E-Bike rental business located at 3576 East River Road South, Medora, ND 58645. By entering into this Agreement, the Renter agrees to rent E-Bike(s) under the terms and conditions set forth herein and acknowledges execution of the Release, Waiver of Liability, and Assumption of Risk.
2. Rental Details and Fees
The Renter agrees to rent the specified number of E-Bikes for the chosen rental duration, with the following rates:
$40.00 – Two Hours
$50.00 – Three Hours
$60.00 – Four Hours
$70.00 – Five Hours
$80.00 – Full Day
Payment is due prior to the rental period. A security deposit of $100.00 is required in addition to the rental fee and will be refunded upon the safe and timely return of the E-Bike(s), provided there is no damage or policy violation.
3. Eligibility
All E-Bike operators must be at least sixteen (16) years of age. Minors under the age of 16 may not operate an E-Bike without direct written consent from a parent or legal guardian, who must also sign the required waiver.
4. Renter Code of Conduct and Use Restrictions
By renting E-Bike(s), the Renter agrees to adhere to the following Code of Conduct:
Operate the E-Bike(s) responsibly, respectfully, and within legal limits.
Follow all local traffic laws, trail regulations, and manufacturer safety instructions.
Do not exceed the speed limit of 22 miles per hour.
Report any accidents, injuries, or equipment issues immediately to Iron Horse staff.
Do not ride under the influence of alcohol, drugs, or controlled substances.
No racing, stunts, off-road riding, or overloading beyond manufacturer limits.
Do not leave E-Bikes unattended or unsecured in public spaces.
Be courteous to pedestrians, wildlife, staff, and the public at all times.
5. Zero Tolerance Policy
Iron Horse Rental Co., LLC enforces a strict zero-tolerance policy regarding the following:
Sexual abuse, harassment, and misconduct: Includes any unwanted or inappropriate physical contact, verbal remarks, or behavior that violates personal boundaries or laws.
Bullying or intimidation: Verbal, physical, or psychological bullying of any kind—including cyberbullying—toward staff, other renters, or the public is strictly prohibited.
Concussions or health incidents: Renters involved in a crash, fall, or collision must stop riding and assess for signs of concussion. If a head injury is suspected, the renter must discontinue use and seek medical attention. Iron Horse staff reserves the right to terminate the rental for safety concerns.
6. Compliance with Regulations
All renters must comply with applicable local, state, and federal laws, trail rules, and Iron Horse Rental Co. regulations and by-laws. These may be updated and are available upon request.
7. Termination and Consequences of Misconduct
Violation of any part of this Agreement—including prohibited behaviors or unsafe conduct—may result in:
Immediate termination of the rental,
Forfeiture of deposit,
Permanent disqualification from future rentals,
Notification of law enforcement or relevant authorities, as applicable.
8. Right of Refusal
Iron Horse Rental Co., LLC reserves the right to refuse service or rental to any individual at its sole discretion.
9. Governing Law and Dispute Resolution
This Agreement shall be governed by the laws of the State of North Dakota. Any legal dispute arising from this Agreement shall be resolved by binding arbitration in Billings County, North Dakota, pursuant to the Rules of the American Arbitration Association.
