Terms and Conditions
1. Agreement Overview
By renting an e-bike from Iron Horse Rental Co., you (“the Renter”) agree to abide by these Terms and Conditions. This agreement is binding once the rental is confirmed and payment is received.
2. Eligibility and Requirements
- Renters must be 18 years or older to rent an e-bike.
- Minors (ages 16-17) may operate an e-bike only with parental or guardian consent and supervision.
3. Rental Period and Returns
- Rental Duration: Rental periods are available on an hourly, full-day, or multi-day basis.
- Return Time: E-bikes must be returned by the agreed time. Late returns may result in additional charges.
- Early Returns: No refunds will be issued for early returns.
4. Payment and Fees
- Payment Method: Full payment is required before the rental period begins.
- Late Fees: Late returns may be subject to a fee.
- Damage Fees: Any damage beyond normal wear and tear will be charged to the Renter.
5. Cancellation and Refund Policy
- Cancellations: Cancellations made 7 days or more before the rental period are eligible for a full refund.
- No-Show Policy: No refunds will be issued for no-shows.
6. E-Bike Usage and Safety Guidelines
- Helmet Use: Helmets are provided and must be worn at all times while riding.
- Road Rules: Renters must obey all local traffic laws and park regulations.
- Prohibited Activities:
- No riding under the influence of alcohol or drugs.
- No off-road riding or riding on unauthorized trails.
- No carrying passengers or exceeding the weight limit.
7. Liability and Assumption of Risk
- Assumption of Risk: The Renter acknowledges the inherent risks of cycling and assumes full responsibility for any injuries or damages that may occur.
- Release of Liability: Iron Horse Rental Co. is not liable for any injury, loss, or damage sustained while using the e-bike.
- Renter Responsibility: The Renter is responsible for returning the e-bike in the same condition it was received.
8. Damage, Theft, and Loss
- Damage Fees: Renters are responsible for the cost of repairing any damage beyond normal wear and tear.
- Theft or Loss: In the event of theft or loss of the e-bike, the Renter will be responsible for the full replacement cost of the e-bike.
9. Insurance
- Iron Horse Rentals Co. does not provide insurance coverage for personal injury or property damage. Renters are encouraged to carry their own insurance.
10. Acknowledgment and Agreement
By signing this agreement or completing the rental process, the Renter acknowledges that they have read, understood, and agreed to these Terms and Conditions.
11. Governing Law
These Terms and Conditions are governed by the laws of the State of North Dakota. Any disputes will be handled in the appropriate jurisdiction of North Dakota courts.
